1. Acceptance of Terms

By accessing or using the FanFuzer platform, including our website (www.fanfuzer.com), mobile application, and related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you and FanFuzer ("we," "our," or "us"). We may update these Terms from time to time, and your continued use of the Platform constitutes acceptance of any changes.

2. Eligibility

You must be at least 16 years old to use the Platform. If you are under 18, you must have parental or guardian consent. By using the Platform, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Platform Services

4.1 Ticket Sales

FanFuzer facilitates the sale of event tickets between event organizers/artists and fans. We act as an intermediary platform and are not the seller of tickets unless explicitly stated. All ticket prices displayed on the Platform are final prices. We do not add hidden fees, service charges, or dynamic pricing surcharges.

4.2 FanPoints Rewards

FanPoints are loyalty rewards earned through eligible transactions on the Platform. FanPoints have no cash value and cannot be transferred, sold, or exchanged for currency. We reserve the right to modify the FanPoints program, including earning rates, redemption options, and point expiration, at any time with reasonable notice.

4.3 Spotify Integration

The Platform offers optional integration with Spotify to enhance your experience. By connecting your Spotify account, you authorize us to access your music preferences as described in our Privacy Policy. This integration is governed by Spotify's own terms of service in addition to these Terms.

4.4 Future Services

We may introduce additional services including but not limited to live streaming, merchandise sales, and artist-fan messaging. These services will be subject to additional terms as applicable.

5. Ticket Purchases and Refunds

• All ticket purchases are final unless the event is cancelled or rescheduled by the organizer.
• In the event of cancellation, you will receive a full refund to your original payment method.
• In the event of rescheduling, your ticket will be valid for the new date. If you cannot attend the rescheduled event, you may request a refund within 14 days of the rescheduling announcement.
• Refunds are processed within 5-10 business days.
• We are not responsible for the quality, safety, or legality of events listed on the Platform.

6. Prohibited Conduct

You agree not to:

• Use automated tools, bots, or scripts to purchase tickets or access the Platform.
• Resell tickets purchased through the Platform at a markup (scalping).
• Create multiple accounts to circumvent purchase limits.
• Provide false or misleading information.
• Interfere with or disrupt the Platform or its infrastructure.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Use the Platform for any illegal purpose.
• Harass, abuse, or threaten other users, artists, or event organizers.
• Circumvent or attempt to circumvent our anti-bot or anti-scalper measures.

7. Artist and Event Organizer Terms

If you use the Platform as an artist or event organizer, additional terms apply:

• You are responsible for the accuracy of event information, including date, time, venue, and pricing.
• You must honor all tickets sold through the Platform.
• You agree to FanFuzer's transparent pricing model: no hidden fees may be added.
• You are responsible for complying with all applicable laws regarding your events.
• FanFuzer retains a platform fee as disclosed in your artist agreement.

8. Intellectual Property

The Platform, including its design, code, content, logos, and trademarks, is owned by FanFuzer and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

By posting content on the Platform (e.g., profile information, reviews), you grant FanFuzer a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, FanFuzer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Platform.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to FanFuzer in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless FanFuzer, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy or completeness of any event information provided by third-party organizers.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Ireland. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Ireland. For EU consumers, this does not affect your rights under mandatory consumer protection laws in your country of residence.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and intellectual property) shall survive.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
